In India, homosexuality is no longer a crime. With a historic decision, the Indian Supreme Court decriminalized homosexuality by deleting the section
377 of the Indian Penal Code which for 157 years punished these behaviors as "offenses against nature". The Ani news agency writes. So far, being gay could cost up to 10 years in prison. The college, composed of five judges, was presided over by Dipak Misra. "Criminalizing homosexuality is irrational and indefensible," said the president, explaining the verdict.

The sentence comes after years of battle: a similar decision by the Delhi High Court, in 2009, was then canceled in 2013 by the same Supreme Court, and then return to the agenda in 2017. In celebration the civil rights activists, associations , and the whole international gay community

homosexuality in India will be decriminalized. Confirmed with a ruling on December 11, 2013 after the ruling of the New Delhi court in 2009 that abolished article 377 of the criminal code is now questioned by the Supreme Court: "Our previous ordinance must be reconsidered" let it be known through a note. Criminal offense with the payment of a fine and with imprisonment, the "crime" of homosexuality has been in force in India since 1860, borrowed from the English colonizers. In 2009 the ruling of the capital's court spoke clearly: "Sex in a private place between two consenting adults does not constitute a crime". Article 377 of the Indian Penal Code was considered unconstitutional because it violates the fundamental rights under Articles 14 and 27: "The State must not deny anyone equality before the law or the same respect for the laws within the territory India.
